Article 1 • Purpose

The purpose of these General Terms of Sale is to define the conditions under which Products are marketed by Danaïde to the client. They thus regulate the various stages of realization of the sale of the placing of the order by the Customer.

Article 2 • Products

Products offered for sale by Danaïde are those appearing on the Site on the day of its consultation by the Customer. Each Product will be the subject of a descriptive card which, in addition to the photograph, will contain: the price, the photograph, the available sizes and colors, the composition, as well as the particular characteristics. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and the definition of the colors of the user's screen.

Danaïde undertakes to deliver Products that comply with the current regulations relating to the safety and health of persons in accordance with European provisions, and in particular the legislation on regulated chemical substances.

Article 3 • Prices

Prices are quoted in euros all taxes included, plus delivery ; it being specified that the value-added tax is that in force in metropolitan France on the day of the validation of the order.

The applied prices are those communicated on the Site and confirmed to the Customer during the validation of the order.

The delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed inclusive of all taxes. These costs are the responsibility of the Customer and are charged in addition to the selling price of the Products.

The transfer of the risks of loss and deterioration of the Products will be made after delivery and receipt of the Products by the Customer.

We reserve the right to change our prices at any time but we agree to apply the rates indicated on the Site at the time of your order.

We inform you that in case of display of a wrong price, obviously derisory (cheap price), whatever the reason (computer bug, manual error, technical error.), The command - even validated by us- will be canceled, which we will inform you as soon as possible. Article 4 • Ordering and payment of products

• 4.1 Ordering

The Customer materializes his order by completing the following 5 steps

The total amount of the order, including the price due for the Products, and the delivery costs, is indicated in the summary.

Step 3 : Once the order is verified and if necessary modified, the Customer validates his basket in order to finalize his order by clicking again on "order".

If the Customer has a benefit code, reserved for the best Customers, he must register it in the space provided for this purpose in order to benefit from it.

Step 4 : the Customer enters the delivery and billing information

Apart from the date of birth, the additional address and the delivery information, all the fields are necessary to finalize the order; it being specified that unless the Customer specifies otherwise, the billing address will be automatically the same as the delivery address.

If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will identify himself only with his email address and his password.

The Customer then checks all the information and clicks »confirm» to continue his order.

Step 5 : Entering bank details

The Customer will then access the secure payment screen of the business partner. Danaïde as specified in Article 4.3 below.

Payment is made online by credit card only or by Paypal.

The Customer must enter his credit card number, its validity date and the 3 numbers of the visual cryptogram present on the back of his card, it being specified that in case of payment by American Express card, the Customer will have to communicate 4 digits.

If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

In case of settlement failure, the Customer will have up to 3 attempts to re-enter his bank details. At the end of the 3ème refusal, the Customer will be redirected (e) on the Site to a screen signifying the refusal of payment. The Customer will then be invited to contact Customer Service Danaïde to know the reasons and find together a solution to finalize the order of the Customer.

• 4.2 Confirmation of the order

Upon acceptance of the Customer's payment, the Customer will receive an email confirmation of his order, and summarizing all items ordered, the billing address and delivery and the date of delivery.

The validation of the order by the Customer and the order confirmation sent to the Customer by email by Danaïde following the acceptance of the payment is concluded conclusion of a contract of sale between the Parties and acceptance of the General Conditions of Sale.

The Customer having placed an order will have the possibility to print his bill by connecting on the Site in the download space provided for this purpose.

Danaïde reserves the right not to validate the order in case of:

  • abnormal or abusive claims,

  • abnormal or abusive exchanges and returns,
  • existing dispute (s) with the client.

• 4.3 Payment

The price of the Products purchased is payable in cash, in full on the date of the placing of the order by the Customer. Payment is made online by credit card (Carte Bleue, Visa, Eurocard / Mastercard / American Express, Paypal) at the time of validation of the order by the Customer.

The authorization request for the withdrawal of the card is made at the time of validation of the order on the Site, except in case of unavailability of the servers. Danaïde reserves the right to make a new application for a debit authorization in the event that the first could not be completed due to the unavailability of the servers.

In the event of a payment default, an incorrect address or any other problem on the Customer's account, Danaïde reserves the right to block the Customer's order until the problem is resolved.

Danaïde implements all necessary means to ensure the confidentiality and security of the banking data transmitted on the Site. The Site has a secure online payment system to encrypt your bank data. Payment information is transmitted according to the highest security standards.

The transmission of your banking data is guaranteed by our partner: BNP PARIBAS via its online payment tool MERCANET.

All information exchanged to process the payment is encrypted using SSL (Secure Socket Layer). This data can not be detected, intercepted or used by third parties. BNP PARIBAS verifies that the connection with the Client's browser is secure before sending the payment form to the banking institution that makes the financial transaction.

As BNP PARIBAS is a technical service provider, it does not support disputes relating to orders that are processed directly by the customer service as specified above or, where applicable, by the Customer's bank.

• 4.4 Order Archiving

The order confirmation is recorded on the registers of Danaïde, themselves preserved on a reliable and durable support. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.

Article 5 • Delivery

Danaïde deliver orders accompanied by a delivery note within a maximum of ten (10) working days for delivery to Metropolitan France, and twenty (20) working days for delivery to any other destination, and this from the day following the payment of the order.

Any order registered on the Site from Monday to Friday before 13 hours will be processed the same day; after 14 hours, it will be processed the next day. Any order placed on Friday after 14 hours, Saturday and Sunday will be processed the following Monday; it being specified that orders placed on a public holiday will be processed the next working day.

In case of exceeding the delivery time, not justified by a case of force majeure, the Customer may request the resolution of the sale and obtain within a maximum period of 30 (thirty) days the reimbursement of sums paid on the occasion of the sale.

For orders outside France, when the package intended for export reaches its destination, it will be the responsibility of the consignee to pay the taxes or customs duties that apply to the country of destination. Local authorities can give you useful information.

Article 6 • Receipt of the order - Complaints - Returns

The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery. Any anomaly concerning the delivery such as:

For any return of non-compliant Product, the Customer must respect the following procedure:

  • the Customer must attach to his package the return form previously completed and printed using the return form accessible from the customer area - "My Orders" section. No return will be accepted without the said return form duly completed.

  • The risks and return costs are the sole responsibility of the Customer.

When non-compliance has been established, Danaïde will offer the Customer the refund of the price of the order (price of the Products and delivery costs) as well as the costs of returning the non-compliant Product, at the latest within thirty (30) days from the date of dispatch of the order. notification of confirmation of non-compliance by the customer service department Danaïde.

In case of refund, Danaïde will ensure the reimbursement of all products made compliant, as well as shipping costs incurred, with the exception of taxes and customs duties paid by the customer upon delivery. Returns against payment are not accepted. When receiving a non-compliant item, Danaïde assumes the reimbursement of postal return costs at the level of the fee schedule (Colissimo delivery without recommended) posted by La Poste at 1er March of the current year. Article 7 • Right of withdrawal

• 7.1 Withdrawal period

Within the framework of the right of retraction, defined in the article L.221-18 of the code of consumption, the Customer disposes:

• a period of fourteen (14) calendar days from the date of receipt of the order to cancel the order of any product purchased on the site

• 7.2 Notification of retraction

• 7.3 Return Product Procedure

Returned products must be sent without undue delay and, in any case, at the latest fourteen (14) days after the customer has communicated to Danaïde its decision to retract at the following address:

The returned item must be in good condition and must not have been worn. It must be in its original packaging and, must imperatively be accompanied by the file number provided by Danaïde.

Items returned incomplete, damaged, damaged or soiled by the Customer will not be returned.

The return of products is at the expense and risk of the Customer except in the case where this return is justified by a hidden defect or the non-compliance of the delivered products (reference error, damaged product, etc.), in all these cases. • 7.4 Refund

Upon receipt of the return package, the Customer will be refunded the amount of the returned item (s), including delivery charges, by crediting his credit card. under fourteen (14) days maximum after receipt by Danaïde cancellation of the order placed by the Customer.

It is specified that failure to receive the return package before the expiration of fourteen (14) days after receipt by Danaïde the cancellation of the order, the refund of the amount of the order placed, delivery costs included, may be deferred until the nearest of the two following dates:

Article 8 • Personal Data

Danaïde collects a certain amount of information necessary for the processing of orders.

Article 10 • Limitation of Liability

The placing of an order on the Site implies the knowledge and the acceptance of the procedures in force on the Internet network in particular as regards the technical performances, the times of answer, connection, the interrogations or transfers of information, the risks of cut, the risks of contamination by viruses circulating on the network and in general all the risks related to the use of the Internet network.

Article 11 • Force Majeure

Danaïde will not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if this non-performance is caused by an event constituting a case of force majeure as defined by the positive law .

In such a case, the customer service will inform the Customer of the occurrence of such an event within a period of three (3) days following its occurrence, by e-mail.

After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persist, the order will be canceled and will, if necessary, subject to a refund of Danaïde on the bank card used to place the order within a maximum period of 30 (thirty) days.

Article 12 • Governing Law

If any of the terms of these General Conditions of Sale were invalid, illegal or unenforceable by a court decision, the other provisions of the General Conditions of Sale will remain in force.

The General Conditions of Sale are executed and interpreted in accordance with French law.
